1. Acceptance of Terms

By downloading, installing, accessing, or using Peptide Pulse™ ("the App"), developed and operated by WOW Creates LLC ("Company," "we," "us," or "our"), you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional guidelines or rules posted within the App. These Terms constitute a legally binding agreement between you and the Company.

If you do not agree to all of these Terms, you must immediately stop using the App and delete it from your device. We reserve the right to modify these Terms at any time. Changes become effective upon posting. Your continued use of the App after any modification constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

2. Description of Service

Peptide Pulse™ is a personal educational reference and organizational tool designed to help users organize, log, and review information related to peptide research protocols. The App provides features including a peptide reference library, dose logging, reconstitution calculations, injection site tracking, wellness metric logging, AI-powered educational responses, and data visualization. The App is a passive record-keeping and reference tool. It does not analyze your health, generate diagnoses, create treatment plans, or provide personalized medical recommendations of any kind.

3. Medical Disclaimer and Precautions

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

PEPTIDE PULSE™ IS NOT A MEDICAL DEVICE, MEDICAL APPLICATION, OR HEALTH CARE PRODUCT. THE APP DOES NOT PROVIDE MEDICAL ADVICE, CLINICAL GUIDANCE, DIAGNOSIS, TREATMENT RECOMMENDATIONS, OR ANY FORM OF HEALTH CARE SERVICE. ALL INFORMATION, CONTENT, AND FEATURES PROVIDED WITHIN THE APP, INCLUDING BUT NOT LIMITED TO AI-GENERATED RESPONSES, PEPTIDE REFERENCE DATA, DOSE LOGGING TOOLS, RECONSTITUTION CALCULATIONS, WELLNESS METRIC TRACKING, AND EDUCATIONAL MATERIALS, ARE PROVIDED SOLELY FOR INFORMATIONAL AND EDUCATIONAL PURPOSES.

THE APP IS NOT INTENDED TO BE AND SHOULD NOT BE USED AS A SUBSTITUTE FOR (A) THE ADVICE OF A PHYSICIAN, PHARMACIST, OR OTHER QUALIFIED HEALTH CARE PROFESSIONAL, (B) A VISIT, CALL, OR CONSULTATION WITH A HEALTH CARE PROVIDER, OR (C) PROFESSIONAL MEDICAL JUDGMENT IN ANY CAPACITY. THE USE OF THE APP DOES NOT CREATE A DOCTOR-PATIENT, THERAPIST-PATIENT, PHARMACIST-PATIENT, OR ANY OTHER HEALTH CARE PROFESSIONAL RELATIONSHIP BETWEEN YOU AND WOW CREATES LLC, ITS OWNERS, EMPLOYEES, CONTRACTORS, OR AFFILIATES.

THE APP DOES NOT RECOMMEND, ENDORSE, SUGGEST, OR ENCOURAGE THE PURCHASE, SALE, POSSESSION, OR USE OF ANY PEPTIDE, RESEARCH CHEMICAL, SUPPLEMENT, PHARMACEUTICAL, OR ANY OTHER SUBSTANCE. ANY REFERENCE TO SPECIFIC COMPOUNDS WITHIN THE APP IS BASED ON PUBLICLY AVAILABLE RESEARCH LITERATURE AND IS PRESENTED STRICTLY FOR EDUCATIONAL REFERENCE. THE COMPANY MAKES NO REPRESENTATION REGARDING THE LEGALITY, SAFETY, EFFICACY, OR APPROPRIATENESS OF ANY SUBSTANCE REFERENCED IN THE APP.

YOU SHOULD ALWAYS CONSULT A QUALIFIED HEALTH CARE PROFESSIONAL BEFORE STARTING, MODIFYING, OR DISCONTINUING ANY HEALTH-RELATED PROTOCOL, SUBSTANCE, OR REGIMEN. IF YOU HAVE A MEDICAL EMERGENCY, CALL 911 OR YOUR LOCAL EMERGENCY NUMBER IMMEDIATELY. NEVER DISREGARD OR DELAY SEEKING PROFESSIONAL MEDICAL ADVICE BECAUSE OF INFORMATION ACCESSED THROUGH THIS APP.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT WOW CREATES LLC IS NOT RESPONSIBLE OR LIABLE, DIRECTLY OR INDIRECTLY, FOR ANY DAMAGE, INJURY, HEALTH CONSEQUENCE, OR LOSS ARISING FROM YOUR USE OF OR RELIANCE ON ANY INFORMATION, CONTENT, OR FEATURE PROVIDED BY THE APP.

4. Assumption of Risk

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE APP IS AT YOUR SOLE RISK. YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH YOUR USE OF THE APP AND ANY DECISIONS YOU MAKE BASED ON INFORMATION ACCESSED THROUGH THE APP, INCLUDING BUT NOT LIMITED TO RISKS OF PERSONAL INJURY, ILLNESS, ADVERSE HEALTH EFFECTS, PROPERTY DAMAGE, OR ANY OTHER HARM.

YOU ACKNOWLEDGE THAT THE INFORMATION PROVIDED IN THE APP MAY BE INCOMPLETE, INACCURATE, OUTDATED, OR NOT APPLICABLE TO YOUR INDIVIDUAL CIRCUMSTANCES, HEALTH STATUS, OR JURISDICTION. YOU ARE SOLELY RESPONSIBLE FOR INDEPENDENTLY VERIFYING ANY INFORMATION OBTAINED THROUGH THE APP BEFORE TAKING ANY ACTION BASED ON IT.

YOU AGREE THAT ANY ACTIONS YOU TAKE OR DECISIONS YOU MAKE BASED ON INFORMATION IN THE APP ARE MADE ENTIRELY AT YOUR OWN RISK AND DISCRETION. THE COMPANY SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY CONSEQUENCES RESULTING FROM YOUR DECISIONS OR ACTIONS.

5. User Responsibilities and Eligibility

By using Peptide Pulse™, you represent, warrant, and agree that:

  • You are at least 18 years of age and have the legal capacity to enter into this agreement
  • You are solely responsible for any and all decisions you make based on information in the App, including health-related decisions
  • You will not use the App as a substitute for professional medical advice, diagnosis, or treatment
  • You will consult a qualified health care professional before acting on any information obtained through the App
  • You are responsible for ensuring your use of the App complies with all applicable laws and regulations in your jurisdiction
  • You are responsible for maintaining the security of your device and your locally stored data
  • You will not reverse engineer, decompile, disassemble, or attempt to extract the source code of the App
  • You will not use the App for any unlawful, unauthorized, or commercially exploitative purpose
  • You will not attempt to interfere with, compromise, or disrupt the App or its underlying infrastructure
  • You understand that the App is an educational reference tool and not a health care product

6. AI-Generated Content

The App includes AI-powered features that generate educational responses based on publicly available research literature. You expressly acknowledge and agree that:

  • AI-generated content is for educational and informational purposes only and does not constitute medical advice, professional guidance, or a recommendation to take any specific action
  • AI responses may contain errors, inaccuracies, outdated information, or omissions, and should never be relied upon as the sole basis for any health-related decision
  • AI-generated content does not create any professional relationship between you and the Company
  • You are solely responsible for independently verifying any AI-generated information with qualified professionals before acting on it
  • The Company does not guarantee the accuracy, completeness, timeliness, or reliability of any AI-generated content
  • AI features are subject to the limitations of the underlying technology and may produce unexpected or incorrect results

7. No Endorsement of Substances

The inclusion of any peptide, compound, or substance in the App's reference library does not constitute an endorsement, recommendation, or encouragement to purchase, possess, or use that substance. The App is a neutral organizational tool that allows users to log and track information. The Company takes no position on the legality, safety, efficacy, or appropriateness of any substance referenced within the App. Users are solely responsible for ensuring their activities comply with all applicable federal, state, and local laws and regulations in their jurisdiction.

8. Subscriptions and Payments

Peptide Pulse™ offers free and paid subscription tiers. All paid subscriptions are processed exclusively through Apple's App Store and managed via RevenueCat. The Company does not directly process, store, or have access to your payment card details.

$9.99/month or $79.99/year (save 33%). Includes a 7-day free trial.

Elite Tier

$19.99/month or $149.99/year (save 37%). Includes everything in Pro plus premium features.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your Apple ID settings. Refunds are handled exclusively by Apple in accordance with their refund policies. The Company has no ability to process refunds directly. Pricing is subject to change with notice.

9. Intellectual Property

All content, design, code, graphics, user interface, branding, trademarks, logos, and other intellectual property within Peptide Pulse™ are the exclusive property of WOW Creates LLC and are protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws. "Peptide Pulse" and the Peptide Pulse logo are trademarks of WOW Creates LLC. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works based on the App or its content without our express written permission. Unauthorized use of any intellectual property may result in legal action.

10. Warranty Disclaimer

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WOW CREATES LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

THE COMPANY DOES NOT WARRANT THAT (A) THE APP WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, (B) THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (C) THE INFORMATION OR CONTENT PROVIDED THROUGH THE APP WILL BE ACCURATE, COMPLETE, CURRENT, OR RELIABLE, (D) ANY DEFECTS IN THE APP WILL BE CORRECTED, OR (E) THE APP WILL BE COMPATIBLE WITH ANY PARTICULAR HARDWARE OR SOFTWARE CONFIGURATION.

NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY THE COMPANY OR ITS REPRESENTATIVES SHALL CREATE A WARRANTY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, THE COMPANY'S LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WOW CREATES LLC, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF DATA, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF BUSINESS, HEALTH COMPLICATIONS, ADVERSE HEALTH EFFECTS, BODILY HARM, OR ANY OTHER DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, ANY CONTENT OR INFORMATION OBTAINED THROUGH THE APP, OR ANY ACTIONS TAKEN OR NOT TAKEN BASED ON INFORMATION IN THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT THAT LIABILITY CANNOT BE FULLY EXCLUDED UNDER APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF WOW CREATES LLC FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE TOTAL AMOUNT YOU PAID TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS LESS.

12. Indemnification

You agree to indemnify, defend, and hold harmless WOW Creates LLC, its owners, officers, employees, contractors, agents, and affiliates from and against any and all claims, demands, actions, damages, losses, costs, liabilities, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to: (a) your use of or access to the App; (b) any decisions or actions you take based on information obtained through the App, including health-related decisions; (c) your violation of these Terms; (d) your violation of any applicable law, regulation, or third-party right; (e) any dispute between you and a third party related to your use of the App; or (f) any claim that your use of the App caused harm to you or any third party. This indemnification obligation shall survive the termination of these Terms and your use of the App.

13. Dispute Resolution: Mandatory Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Binding Arbitration. You and WOW Creates LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the App, or your use of the App (collectively, "Disputes") shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. There is no judge or jury in arbitration, and court review of an arbitration award is limited. An arbitrator can award the same damages and relief as a court. The arbitration shall be conducted by a single arbitrator.

Class Action Waiver. YOU AND THE COMPANY AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR SHALL NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND SHALL NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS OR REPRESENTATIVE PROCEEDING.

Exception. Notwithstanding the above, either party may bring an individual action in small claims court for Disputes within the jurisdiction of that court. Either party may also seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

Statute of Limitations. You agree that any claim or cause of action arising out of or related to your use of the App or these Terms must be filed within one (1) year after such claim or cause of action arose, or it shall be permanently barred. This limitation applies regardless of any statute of limitations that might otherwise apply.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Hawai'i, without regard to its conflict of law provisions. To the extent that litigation is permitted under these Terms, you consent to the exclusive jurisdiction of the state and federal courts located in the State of Hawai'i for the resolution of any Disputes not subject to arbitration. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms.

15. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Since your data is stored locally on your device, termination of service does not affect your existing local data. The following sections shall survive termination of these Terms: Medical Disclaimer and Precautions, Assumption of Risk, Warranty Disclaimer, Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law.

16. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect. The invalidity of any provision shall not affect the validity of the remaining provisions.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and WOW Creates LLC regarding your use of the App, and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term. A failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
